No need to change commission and diligence in family actions, says Faculty

Leave well alone, is the suggestion by the Faculty to possible changes in the way commission and diligence is exercised in family actions in the civil courts.
The Scottish Government asked for views on the current law and practice, saying that if it concluded that legislation and/or changes to procedures was required, there would be a full public consultation.
However, in its response, the Faculty stated: “We are of the view that the law in this area does not require to be changed…(and) that the practice and procedure generally works well, and there is no need for any changes in this area.”
